Supreme Federal Court maintains validity of Brazil's Sanitary Vigilance Standard that prohibits flavored and flavored cigarettes

With the tie in the vote (5x5), the Plenary did not reach the minimum of six votes to the action was dismissed

The Plenary of the Federal Supreme Court (STF) concluded on Thursday (1st) the judgment of the Direct Action of Unconstitutionality (ADI) 4874, filed by the National Confederation of Industry (CNI) against the Resolution of the Collegiate Board of Directors (RDC) , of the National Agency of Sanitary Surveillance (Anvisa), which prohibits the addition of aroma and flavor in cigarettes.

As the vote ended tied with five votes against and five favorable to the declaration of unconstitutionality of the resolution of Anvisa - the minister Roberto Barroso declared his suspicion for the judgment -, the minimum quorum of six votes was not reached to declare the invalidity of the norm, and the action was dismissed.
