STF holds a public hearing on decriminalization of abortion on August 3 and 6

On August 3 and 6, in the morning and afternoon, the Federal Supreme Court (STF) promotes a public hearing on the decriminalization of abortion until the 12th week of gestation. More than 40 representatives from the various sectors involved in the issue, among national and international experts, institutions and organizations, were selected to contribute with information for the discussion of the matter, subject of the Action Against a Violation of a Constitutional Fundamental Right (ADPF) 442, filed by the Political Party Socialism and Freedom (PSol).

The hearing begins at 8:20 am on the First Panel of the STF and continues in the afternoon from 2:30 p.m on. Representatives from 13 entities will speak at each shift, each of which will have 20 minutes to do their explanation. Among the speakers will be representatives from the Ministry of Health, the Brazilian Federation of Gynecology and Obstetrics Associations (FEBRASGO), the National Academy of Medicine, the Oswaldo Cruz Foundation (FIOCRUZ), the Federal Psychological Council and the National Conference of Bishops of Brazil (CNBB).

In March this year, ADPF rapporteur Rosa Weber called the hearing on the grounds that the discussion is one of the "most sensitive and delicate" legal issues, as it involves ethical, moral, religious and public health reasons and protection of individual fundamental rights. According to her, more than 180 requests for exhibitor qualification were received at the hearing, covering individuals with a potential authority and representation, non-governmental organizations, civil society and specific institutes. There are requests related to health entities, research institutes, civil organizations and religious and legal institutions.

ADPF

In ADPF 442, the Party questions articles 124 and 126 of the Penal Code, which criminalize the practice of abortion. The PSol requests that the voluntary contraception of the pregnancy during the first 12 weeks of gestation be excluded from the scope of incidence of the two articles, alleging breach of several fundamental principles.

For the author of the action, the devices questioned violate constitutional principles such as the dignity of the human person, citizenship, non-discrimination, inviolability of life, freedom, equality, prohibition of torture or inhuman and degrading treatment, health and family planning of women and sexual and reproductive rights.
