STF approves injunction that guaranteed free expression of ideas in universities

The Federal Supreme Court (STF) has approved a preliminary injunction granted by Justice Carmen Lúcia in the Action Against a Violation of a Constitutional Fundamental Right (ADPF) 548 to ensure the free expression of ideas and thoughts in universities. In her vote, followed by all the Justices, the rapporteur emphasized that the judicial and administrative acts questioned in the Action contravened the Federal Constitution of 1988 and emphasized that university autonomy is among the constitutional principles that guarantee all forms of freedom.

The ADPF 548 was filed by the Prosecutor General of the Republic, Raquel Dodge, against decisions by electoral judges that determined the search and seizure of pamphlets and election campaign materials in universities and in the headquarters of teachers' associations. The decisions also prohibited thematic classes and electoral and political meetings, imposing the interruption of public manifestations in favor or against candidates in the General Elections of 2018 in federal and state universities. The measures supposedly held its legal basis in the electoral legislation, in the point where it prohibits the advertising of any kind in buildings and other public assets (article 37 of Law 9,504/1997).
