STF reaffirms constitutionality of social security contribution of retirees that goes back to work

The Federal Supreme Court (STF) reaffirmed its understanding of the constitutionality of adequate social security contributions by retirees under the General Social Security Regime (RGPS) that remains active in its work or returns to it afterwards. The theme was object of the Extraordinary Appeal with Interlocutory Appeal (ARE) 1224327, which had its general repercussion recognized and its judgment of merit in the Virtual Plenary.

The general repercussion of the matter was unanimously acknowledged. On the merits, the majority accompanied the rapporteur for the dismissal of the appeal and the reaffirmation of the peaceful jurisprudence of the Court. In this part, the Justices Marco Aurélio and Ricardo Lewandowski were defeated.

The thesis was as follows: It is constitutional the social security contribution by a retiree under the General Regime of Social Security (RGPS) that remains in activity or returns to it.
