Supreme Courts of Brazil and China sign a Memorandum of Understanding of cooperation between the judiciaries of the two countries

The Chief Justice of the Brazilian Federal Supreme Court (STF), Ricardo Lewandowski , and the President of China´s Supreme Court , Zhou Qiang , signed on Monday ( 30 ) morning a Memorandum of Understanding for cooperation between the two Supreme Courts. The goal is to exchange experiences in order to assist the development of the judicial system of the two countries and strengthen the cooperation between the two Supreme Courts. The bilateral meeting was held in the city of Haikou, capital of the Chinese province of Hainan.

During the ceremony, Minister Lewandowski stressed the importance of the Forum of the Judicial Branches of the BRICS (Brazil, Russia, India, China and South Africa) and said he was convinced that in a globalized world, partnerships between friendly countries are essential for the achievement of common goals. He said that the 21st century Judicial Branch has an important role, both nationally and internationally, working on issues of great relevance politically, socially and economically, in harmony with the Executive and Legislative Branches of each country.

Minister Lewandowski also highlighted the new level of relationship between the Judiciary of Brazil and China and said the he will engage in implementing, as soon as possible, the actions discussed during his visit to China. When citing exchanges between judges of both countries, provided in the memorandum of cooperation, the minister pointed out that Brazil is ready to receive Chinese judges and share Brazilian experiences. He added that the multi-millennial culture of China will certainly contribute to the professional development of Brazilian magistrates.

The Chief Justice of China, in return, said that the Judicial Branches of both countries have many common challenges to be solved, and that the visit of Minister Lewandowski to China, has expanded the opportunity of cooperation between them. President Zhou stressed the reforms that are being implemented in China's judiciary, in order to make it more dynamic, open and transparent for the benefit of the Chinese people. The reforms aim to provide more guarantees to the performance of judicial activity and to build a more skilled and professional judging panel.

According to Zhou Qiang, it is important that Judicial Branches adopt a global view to be able to confront adequately with issues such as cross-border international crime, environmental protection, legal certainty for investment and exchange between different people.
In this sense, the Chief Justice of China proposed to increase not only the exchange of magistrates between Brazil and China, but also the programs of enabling and sharing good administrative practice, through the fast and effective implementation of the Memorandum of Understanding signed today between the two countries.

Bank of precedents

Lewandowski and Qiang agreed to establish in a short term, a common bank of precedents of BRICS on environmental matters, available to all in the electronic media, as well as hold a seminar on Law and development in Brazil in 2016, with the participation of judges and jurists from Brazil and China.
