Lecture talks about admissibility of requests for advisory opinions to the Permanent Review Tribunal of Mercosur

During the morning of this Friday (24), the 4th Mercosur Supreme Courts Meeting presented a panel on "Regulation of requests for consultative opinions to the Mercosur Permanent Review Tribunal".

The panel was chaired by justice Ricardo Lewandowski of the Brazilian Federal Supreme Court (STF) and reported by Professor Márcio Garcia of the Center for the Study of International Law - CEDI.

Justice Ricardo Vigil Toledo (Judge of the Court of Justice of the Andean Community), Professors João Grandino Rodas (Arbiter Titular of the Mercosur Permanent Court), José Antônio Moreno Rufinelli (President of the Mercosul Permanent Court) and Professor Adriana Dreyzin de Klor (National University of Córdoba) debated the subject.

During the panel, Justice José Raúl Torres Kirmser, of the Supreme Court of Justice of the Republic of Paraguay, presented a draft "Regulations for the processing of requests for advisory opinions sent by higher courts of the states parties." The justice highlighted in his speech Article 2, which establishes who is responsible for deciding on the referral of requests for advisory opinions to the Permanent Review Tribunal, exercising, in respect of them, the previous admissibility judgment.

By the preliminary draft, the courts apt to grant the admissibility of the requests are: Supreme Court of Justice of La Nación (by Argentina); Supreme Court (for Brazil); Supreme Court of Justice (for Paraguay); And the Supreme Court of Justice (for Uruguay).
