Justice Edson Fachin is randomly selected as the new Justice Rapporteur of the Lava Jato case

Thursday, February 2nd, 2017

Justice Edson Fachin, of the Brazilian Federal Supreme Court (STF), was randomly selected on Thursday morning (2) as the new Justice Rapporteur on the cases related to the Lava-Jato operation. In today’s morning was published in the Judicial Gazette the decision of Chief Justice Cármen Lúcia validating the request of transfer submitted by Justice Edson Fachin from the First to the Second Panel, which had a vacancy due to the death of the original rapporteur of the case, Justice Teori Zavascki, who died on 19 January.

The first case redistributed by determination of the president of the STF was the Criminal Investigation (Inq) 4112 and it was disclosed via electronic system in the Case Distribution Report of the STF at around 11:20 am. As the case related to the Lava Jato operation are under the jurisdiction of the Second Panel of the STF, all of them will be forwarded to the office of Justice Edson Fachin.

After the last plenary session of the year, the office of Justice Teori Zavascki released a worksheet of proceedings related to the Lava Jato operation. Criminal investigations and lawsuits, injunctions and writs of habeas corpus are presented on the worksheet and do not include, for example, more recent proceedings, such as the homologation of the 77 plea agreements signed between the executives of the construction company Odebrecht and the Office of the Prosecutor General. The president of the STF signed the homologation of the plea bargains last Monday (30), in the judicial recess, and all the documentation was sent to the Prosecutor General's Office.
