STF will decide if foreigner is entitled to welfare benefit

The Brazilian Federal Supreme Court (STF) began to judge on Wednesday (19) the Extraordinary Appeal (RE) 587970, with general acknowledged repercussion, in which the possibility of granting the Continuous Service Benefit (BPC) to a foreign resident in Brazil is discussed.

The RE was filed by the National Social Security Institute (INSS) against the decision of the First appellate Panel of the Federal Special Court of the 3rd Region, which condemned the federal authority to grant to a foreigner of Italian origin the welfare benefit provided for in article 203, item V, Of the Federal Constitution, in the amount of a minimum wage.

At the meeting today, the rapporteur for the case, justice Marco Aurélio, presented his report on the case and then oral statements were made. The trial will be resumed at this Thursday's session (20).
