Social security contribution affects remuneration of political agents

Thursday, May 25, 2017

The Plenary of the Brazilian Federal Supreme Court (STF) decided that federal entities must pay social security contributions on the remuneration of political agents not tied to their own social security system. The matter was analyzed on Thursday (25) during the trial of Extraordinary Appeal (RE) 626837, which had general repercussion recognized.

The Justices approved the following thesis of general repercussion, to be applied by the ordinary courts of the Judiciary to similar cases: "Social security contribution affects the income paid to the holders of elective office arising from the rendering of services to the Federal Government, the States and the Federal District or to municipalities after the advent of Law 10.887/2004, provided that they are not tied to their own regime of social security".
