It is suspended the rule of the municipality of PR that prohibits teaching on gender and sexual orientation

It is suspended the rule of the municipality of PR that prohibits teaching on gender and sexual orientation.

Justice Luís Roberto Barroso, of the Brazilian Federal Supreme Court (STF), granted an preliminary injunction in Allegation of Fundamental Precept (ADPF 461) to suspend the Paranaguá (PR) law that prohibits teaching about gender and sexual orientation in schools in the municipality. In his decision, the Justice considered to be plausible the allegations raised in the file, as well being configured the danger of the delay, since the contested rule "promises the immediate access of children, adolescents and young people to contents pertinent to their intimate and social life, in disrespect of the doctrine of integral protection".

The Federal Attorney General, Rodrigo Janot, the author of the action in the STF, argued that Law 3.468 / 2015, which approves the municipal education plan, prohibits, at the end of line X of article 3, the adherence of politics of teaching that tend to apply the gender ideology, as well the use of the terms "gender" and "sexual orientation" in schools. The device, for Janot, contradicts various constitutional precepts, such as the principle of building a free, fair and supportive society; The principle of equality; From prohibition to censorship in cultural activities; The laity of the state; The pluralism of ideas and pedagogical conceptions; among others. It also violates the exclusive competence of the Union to legislate on the guidelines and bases of national education.
