STF concludes trial on limits of rapporteur's performance in award-winning collaborations

The Plenary of the Brazilian Federal Supreme Court (STF) concluded the Petition (PET) 7074 and decided, by majority vote, that the collaboration agreement approved as regular, voluntary and legal should, as a rule, produce its effects in the face of compliance Of the duties assumed by the collaboration, enabling the collegial body to analyze paragraph 4 of article 966 of the Code of Civil Procedure. The aforementioned provision says that "acts of provision of rights, practiced by the parties or other participants in the process and approved by the court, as well as the acts of homologation practiced in the course of execution, are subject to annulment, under the terms of the law."

Regarding the distribution by prevention of PET 7003, the decision was unanimous in maintaining the case under the report of Minister Edson Fachin. The ministers agreed that the distribution for prevention to Inquiry 4112 and the facts investigated by Operation Lava-Jet was done legally and correctly.
