The Chief Justice of the Brazilian Federal Supreme Court (STF), Carmen Lúcia, rejected the Writ of Mandamus (MS) 34991 and rejected the request for injunction in the Mandatory of Security (MS) 34994, both filed by federal deputies against the refusal, by the president of the Comission for the Constitution, Justice and Citizenship (CCJC), Rodrigo Pacheco (PMDB / MG), of requests for the hearing of persons and request of documents for the analysis of the complaint for a crime of passive corruption (Request for Establishment of Process - IAPA 1/17) against the President of the Republic, Michel Temer.
The president of the CCJC rejected the requests on the grounds that the production of evidence, including the interrogations of the accused and testimony of witnesses, as well as the performance of expert witnesses, should occur before the STF, which is responsible for the prosecution of any criminal action against The President of the Republic.
