The Chief Justice of the Brazilian Federal Supreme Court (STF), Carmen Lúcia, rejected the Writ of Mandamus (MS, in portuguese) 35008, through which Senator Randolph Rodrigues Alves (Rede-AP) and federal deputies Alessandro Molon (Rede-RJ) Sérgio Olímpio Gomes (SD-SP), Aliel Machado (Rede-PR), Arnaldo Faria de Sá (PTB-SP) and Júlio Delgado (PSB-MG) requested the annulment of the substitutions that occurred within the scope of the Constitution Commission, Justice and Citizenship (CCJ) of the Chamber of Deputies since the communication, to the Legislative House, of the denunciation offered against President Michel Temer for passive corruption. The assessment of opinion in the CCJ is one of the steps in the Chamber of Deputies for the admissibility of the complaint against the head of the federal Executive.

The Chief Justice's action in the case was based on Article VIII, item VIII, of the STF Internal Rules, according to which the Presidency is responsible for deciding urgent matters during recess or vacation periods.
