ADI against decree that increases taxes on fuels will be analyzed by the rapporteur

Justice Carmen Lúcia concluded that it is not up to the Chief Justice of the Brazilian Federal Supreme Court (STF) to act immediately on the Direct Action of Unconstitutionality (ADI) 5748, in which the Workers' Party (PT) questions a decree edited by the President of the Republic that increases taxes (PIS / pasep and Cofins) on fuels. The case will be examined by the rapporteur, Justice Rosa Weber.

The STF Chief Justice pointed out that in a popular action filed in the Federal Justice, for the same purpose, the anticipation of guardianship was granted in the first instance, later suspended by decision of the president of the Federal Regional Court of the 1st Region (TRF-1). Given this context and to provide greater legal certainty, due to the proximity of the final forensic recess of July, the justice considered it advisable that the request be examined by the ADI rapporteur, "who is responsible for ordering and directing the process”.

"For the foregoing, there is nothing to be provided immediately by this Presidency, and we must await the return of the eminent Justice Rapporteur, emphasizing the urgency of the case," concluded the president.
