STF declares unconstitutionality of federal act that regulates use of chrysotile asbestos

By majority, the Plenary of the Brazilian Federal Supreme Court (STF), in a session last Thursday (24), dismissed the Direct Action of Unconstitutionality (ADI) 3937, filed by the National Confederation of Industry Workers (CNTI) against Act 12,687/2007, of the State of São Paulo, which forbids the use of products, materials or artifacts containing any type of asbestos in the State territory.

The Justices also declared, incidentally, the unconstitutionality of article 2 of Federal Act 9,055/1995, which allowed the extraction, industrialization, commercialization and distribution of asbestos in the chrysotile variety in the country. Thus, with the judgment of ADI 3937, The Supreme Court ruled the provision of the federal norm that authorizes the use of this modality of asbestos unconstitutional and established the validity of the State norm that forbids the use of any type.
