Deputy questions a decree that extinguishes mineral reserves in the Amazon

Federal Deputy Glauber de Medeiros Braga (PSOL-RJ) has questioned in the Brazilian  Federal Supreme Court (STF) the presidential decree that extinguishes the National Reserve of Copper and its Associates (Renca), located between the states of Pará and Amapá. In the writ of mandamus (MS) 35143, which has a preliminary injunction, the deputy sustains that the decree invades the competence of the National Congress to deliberate on the matter, affecting its right, as a parliamentarian, to participate in due process of law. The case was distributed to the minister's report Gilmar Mendes.

The request sustains that there is an affront to Article 49 of the Federal Constitution, items XVI and XVII, in which is established exclusive competence of the National Congress to authorize the exploitation of resources in indigenous areas and to approve the alienation of public lands with an area of more than 2,500 hectares. It further understands that by the size of the mineral reserve, affecting two states, the decree means a regional and sectoral development action, also subject to the deliberation of the Congress according to article 48, item IV, of the Federal Constitution.
