Based on the excessive deadline for completing proceedings, the Second Chamber of the Brazilian Federal Supreme Court (STF) ex officio revoked the preventive detention of J.M.S., who had been imprisoned for more than four years, pending trial, on charges of drug trafficking. The decision was unanimously taken this Tuesday's session (19), during the Habeas Corpus' (HC) 141583 trial.
Flagged with half a kilo cocaine on the beach of Pipa, in Tibaú do Sul (RN), J.M.S. was arrested in August 2013 and charged drug trafficking (articles 33 and 35 of Act 11,343/2007).
In his vote, the rapporteur Justice Edson Fachin pointed out that this is a evident case of excessive pre-trial detention.
