Justice Carmen Lúcia sends a complaint against Michel Temer to the Chamber of Deputies

The president of the Federal Supreme Court (STF) referred to the Chamber of Deputies the denunciation offered against the President of the Republic, Michel Temer, in the records of the Inquiries (INQs) 4327 and 4483. The complaint, which points to the practice of crimes criminal organization and obstruction of justice, was taken to the Chamber by the director general of the STF, Eduardo Toledo.

The referral of the accusatory piece to the Chamber was approved today by the STF Plenary, in judging two points of order presented by the defense of the President of the Republic. Once the defense's claims were upheld, the Court decided to continue the proceedings.

The rapporteur then referred the files to the Justice Carmen Lúcia, to promote "the institutional referral to the Presidency of the Chamber of Deputies, for the purposes of the provisions of art. 51, I and art. 86 of the Constitution of the Federative Republic of Brazil, and thus take the respective parliamentary deliberation regarding the authorization to initiate proceedings".

Article 51, item I, of the Federal Constitution, establishes that it is up to the Chamber of Deputies to authorize, by a vote of two thirds of its members, the institution of proceedings against the President of the Republic. Once the accusation is admitted, he will be submitted to trial before the Federal Supreme Court, in common criminal offenses, as provided in article 86.
