Preliminary injunction guarantees to the curator of the exhibition Queermuseu right to silence in testimony to the parliamentary inquiry committee

Wednesday, October 04, 2017

Justice Alexandre de Moraes of the Brazilian Federal Supreme Court (STF) granted an preliminary injunction in Habeas Corpus (HC 148615) to guarantee the curator Gaudêncio Cardoso Fidélis the right to be assisted by a lawyer and to remain silent during testimony scheduled for this Wednesday (4), starting at 2.30 pm, in the Parliamentary Commission of Inquiry (CPI) of the Federal Senate that investigates irregularities and crimes related to mistreatment of children and teenagers in the country.

According to the defense, the request that gave rise to the convocation "clearly suggests" that Gaudêncio "will be heard in the condition of being investigated on facts related to the absurd supposed incitement to pedophilia in the face of an artistic exhibition". The curator's defense intended that the convocation be suspended alleging that it would be "fraught with vices" and that it would have been presented in a precarious manner, by e-mail, in disagreement with legal provisions.
