Retrial to surrender extradited citizens who return to Brazil waived by Second Chamber

In a unanimous decision, the Second Chamber of the Brazilian Federal Supreme Court (STF) upheld the decision of Justice Gilmar Mendes, who authorized the surrender of Spanish citizen Miguel Angel Durán Abad to the Spanish government, waving the need for a new extradition case by the requesting country.

Duran Abad's extradition was granted by the STF in September 2011 in Extradition Case (EXT) 1225. In Spain, he was sentenced to 23 years in prison for participating in the murder of a lawyer in 2008. However, this first trial was canceled and when a second one was nigh, Miguel Angel Durán Abad did not appear. He fled Spain and returned to Brazil with false identity.
