Justice replaces pretrial detention of mother of two into house arrest

Justice Ricardo Lewandowski of the Brazilian Federal Supreme Court (STF) ordered the replacing the pretrial detention of J.V.C., the mother of two young children, for house arrest, making it up to the local court to assess the need for other precautionary measures under Article 31 of the Code of Criminal Procedure (CPP). She was arrested in September due to alleged smuggling, fake document forgery and disloyal practice of law. The Justice's decision was given in Habeas Corpus (HC) 149065.

The HC was filed in the Supreme Court against the decision of a Superior Court of Justice (STJ) judge that rejected the preliminary injunction in habeas corpus filed there. In bringing the case to the Supreme Court, J.V.C.'s defense brought documents that prove that she is the mother of two children, one of three years and another of three months, still in the breastfeeding phase, both of which she has the custody.
