Brazilian Federal Supreme Court recognizes that transgender may change their civil registry without gender redesignation

The Brazilian Federal Supreme Court (STF) considered that it is possible to change name and gender in the civil registry even without performing a surgical reassignment procedure. The was handed down during the judgment of the Direct Action for Declaration of Unconstitutionality (ADI) 4275 at the plenary session held on the Thursday afternoon (1st).

The action was filed by the Prosecutor-General's Office (PGR) in order to give interpretation according to the Federal Constitution to article 58 of Act n. 6.015/1973, which provides for public records, in the sense that it would be possible to change the name and gender in the civil registry regardless of transgenitalization surgery.

All the justicesof the Court recognized the aforementioned right, and the majority understood that, for the amendment, no judicial authorization is necessary.
