Justice orders the return to lower courts of lawsuits against federal parliamentarians applying new understanding of the Brazilian Federal Supreme Court

Justice Dias Toffoli of the Brazilian Federal Supreme Court of Brazil (STF) has declined jurisdiction over six Criminal Actions (AP) and an investigation against federal parlamentarians which were under his report. The Justice ordered the proceedings to be returned to the competent authorities after the end of the plenary session on Thursday (3), when the judgment of an objection was concluded in AP 937, in which the plenary court decided that, in the case of federal parliamentarians, the jurisdictional prerogative in the STF will be restricted to cases of common crimes committed in the exercise of the position and related to the function.

The Justice ordered the return to lower courts of criminal charges against federal parlamentarians Alberto Fraga (AP 907), Roberto Góes (AP 928), Marcos Reátegui (AP 945), Cícero Soares (AP 956), Hélder Salomão (AP 1004) and Hidekazu Takayama (AP 647), because the crimes for which the defendants were charged were not committed during the exercise of the position nor related to the public function. The Justice also ordered the return of INQ 3010, which is processed in secrecy.
