While reconsidering a decision taken in June this year, the Chief Justice of the Brazilian Federal Supreme Court (STF), Justice Carmen Lúcia, granted Suspension of Injunction (SL) 1157 to release a contract signed between Telecomunicações Brasileiras S/A (Telebras) and the US company ViaSat Inc. to exploit the Ka band capacity of the Brazilian Geostationary Satellite of Defense and Strategic Communications (SGDC).
The contract was suspended by a decision of the 1st Federal Court of Manaus (AM), held by the head of the Federal Regional Court of the 1st Region (TRF-1). The Federal Government then filed a lawsuit (SL 1157) in the Supreme Court requesting the release of the partnership, but on June 1 of this year, the STF's Chief Justice rejected the request and upheld the decision of the Federal Court.
The Federal Government requested the reconsideration of the decision of the Justice alleging damages to the public interest and serious damage to the public and economic order. It was added that the partnership agreement will enable ViaSat equipment to operate 100% of satellite capacity and to provide broadband services, within the public policy of digital inclusion for the most distant regions of the country.
