Custody hearing and house arrest of mothers and pregnant women are highlights of Inter-American Commission on Human Rights' (IACHR) Report

The implementation of the custody hearings and the decision of the Second Chamber of the Brazilian Federal Supreme Court (STF) that granted a collective habeas corpus to all pregnant women and mothers of children up to 12 years of age who were preventively detained were the highlights of the preliminary observations of the Inter-American Commission on Human Rights (IACHR) after a visit to Brazil, between 5 and 12 of november, 2018, at the invitation of the Brazilian State. According to the document, "the IACHR welcomes the various efforts of the Brazilian State in this area, especially those aimed at reducing pre-trial detention, such as increasing the effectiveness of judicial control of detention through custody hearings and promoting the application of alternative measures".

Noting that Brazil has the fourth largest prison population in the world (726,712 prisoners), the IACHR emphasized that "one of the main advances in reducing its use - and which represents good practice at the regional level - is the implementation of custody hearings, which may reduce the rate of pre-trial detention in cases of flagrante delicto".
