Plenary of the Brazilian Federal Supreme Court reaffirms the competence of the Electoral Court to try common crimes related to electoral crimes.

The Plenary of the Brazilian Federal Supreme Court (STF) has confirmed jurisprudence in the sense of the jurisdiction of the Electoral Court to process and prosecute common crimes that have a connection with electoral crimes. The Court also observed that it is the task of the specialized Court to analyze, on a case-by-case basis, the existence of a connection between common crimes and electoral offenses and, if it does not, refer the cases to the competent court.

The matter was assessed in the judgment of appeal (internal interlocutory appeal) filed by the defense of the former mayor of Rio de Janeiro, Eduardo Paes, and of the federal deputy, Pedro Paulo, (DEM-RJ) in the Inquiry (INQ) 4435, in which they are investigated by facts allegedly occurred in 2010, 2012 and 2014.
