Brazilian Federal Supreme Court considers that a Brazilian Traffic Code (CTB) ruling that allows the National Traffic Council (Contran) to create sanctions for traffic violations is unconstitutional

By a majority of votes, the Plenary of the Brazilian Federal Supreme Court (STF), at session on Wednesday (10), partially upheld the Action for the Declaration of Unconstitutionality (ADI) 2998 and dismissed the possibility of establishing sanctions by the National Council of Traffic (Contran). The lawsuit was filed by the Federal Council of the Brazilian Bar Association (OAB) against rules established in the Brazilian Traffic Code (CTB - Law 9.503 / 1997) which condition the issuance of the new vehicle registration certificate and the annual license certificate to the payment of debts related to taxes, charges and fines linked to the vehicle, regardless of the responsibility for the infractions committed.
