Expansion of remunerated services offered by civil registry offices is constitutional

The Plenary of the Brazilian Federal Supreme Court (STF) has considered valid the permission for the offices of civil registry of natural persons to provide other remunerated services, as long as they are related to the activities of the notary office and the agreement that authorizes them is approved by the Judiciary. The understanding was established in the analysis of the Action for the Declaration of Unconstitutionality (ADI) 5855, considered partially valid in the session of this Wednesday (10).

The lawsuit was filed by the Brazilian Republican Party (PRB) to question changes in the Public Registration Law (Law 6,015 / 1973) that allow the provision of "other remunerated services" by offices of civil registry of natural persons.

With the decision, the effectiveness of the Decision 66 of the National Council of Justice (CNJ) was reestablished, which provides delivery of services related to the identification of people by notary offices through convenant, accreditation and registration with government and private agencies and entities.
