Full text of the vote of the Justice Celso de Mello in the action calling for criminalization of homophobia

At the beginning of the session on May 23, the Plenary of the Brazilian Federal Supreme Court (STF) analyzed a statement from the Federal Senate that the Constitution and Justice Commission (CCJ) approved, on Wednesday, the project of law that includes crimes of discrimination or prejudice of sexual orientation or gender identity in Law 7.716 / 1989, which typifies crimes of racism.

By the majority of the votes, the Justices understood that the fact did not interrupt the so-called legislative delay and decided to continue the trial of Action for the Declaration of Unconstitutionality by Omission (ADO) 26, with report by Justice Celso de Mello, and the Injunction (MI) 4733, reported by Justice Edson Fachin. Justice Marco Aurélio and Chief Justice Dias Toffoli (president) were defeated in their votes.

So far, six votes have been delivered, all of which showing an undertanding that the National Congress has failed to protect the LGBT community. The trial will be resumed at the session on June 5.
