Brazilian Federal Supreme Court frames homophobia and transphobia as crimes of racism by recognizing legislative omission

The Plenary of the Brazilian Federal Supreme Court (STF) understood that there was an unconstitutional omission by the National Congress for not issuing a law that criminalizes acts of homophobia and transphobia. The trial of the Direct Action for the Declaration Unconstitutionality by Omission (ADO) 26, reported by Justice Celso de Mello, and the Injunction Order (MI) 4733, reported by Justice Edson Fachin, was concluded on thid Thursday afternoon.

By a majority, the Court recognized the delay of the National Congress to incriminate acts that violate the fundamental rights of members of the LGBT community.
