Brazilian Federal Supreme Court (STF) receives a Brazilian Bar Association's action against contingency of federal universities budget

The Federal Council of the Brazilian Bar Association ("OAB") filed an Action Against the Violation of a Constitutional Fundamental Right (ADPF) 595, in the Brazilian Federal Supreme Court (STF), in order to question acts of the Federal Executive Branch that resulted in the contingency of public funds allocated to universities and federal institutes. At the court, the Direct Action of Unconstitutionality (ADI) 6127 and the ADPFs 582 and 583, dealing with the same matter, are pending. The rapporteur of the four cases is Justice Celso de Mello.


The Federal Council of the OAB requests the grant of an injunction to suspend the blockades and to prohibit new contingencies. On the merits, it requires the declaration of invalidity of the contingencies and that binding guidelines be established in the sense of the impossibility of "arbitrary" contingencies that preclude the operation of higher education institutions.
