During the launch of the pilot project for integration between the Electronic Judicial Process platform (PJe) and “”, at the Brazilian Federal Supreme Court (STF), the president of the National Justice Council (CNJ) and the STF, Chief Justice Dias Toffoli, said the integration of the platforms strengthens the multiport dispute settlement system. "The technological level in which we find ourselves requires that the expansion of self-compositional methods, using digital platforms, occurs through interconnection with the electronic process," he said.

He stressed the high productivity and the constant advances made by the Judiciary in Brazil. “In 2018, and it is important to highlight, especially when criticizing the judiciary, we recorded 1700 sentences per judge per business day. It is a fabulous work that demonstrates the operability of our judiciary, ”he said. The integration between the two platforms is the result of the Cooperation Agreement established between the CNJ and the Ministry of Justice and Public Security (MJSP), made through the National Consumer Secretariat (Senacon).

Initially, the action will be restricted to the Federal Regional Court of the 1st Region (TRF1) and the Court of Justice of the Federal District and Territories (TJDFT). The initiative allows the citizen who has a lawsuit in the PJe to have the possibility to conduct an online negotiation, without delaying or interfering with the progress of the action. By expressing interest in the search for reconciliation, the company will have up to ten days to contact, clarify or propose agreement. After the company responds, the plaintiff informs if the issue has been resolved or not.

Dias Toffoli reported that 10% of the actions opened in 2018 were related to consumer issues, which, according to him, increases the importance of the agreement between the CNJ and MJSP in the resolution of consumer actions. He stressed that the initiative reinforces the technological advances of the Brazilian judiciary and cited as examples the judgments made in virtual plenary.

CNJ Assistant Judge Lívia Peres stated that, more than platform integration - PJe and - it was an integration of institutions and people. She explained that the service is free of charge and does not interfere or delay the legal process and that, in the initial phase, will be focused only on cases of TRF1 and TJDFT special courts that involve consumer issues related to the banking segment. “The goal is to offer one more option to the plaintiff via PJe. Our idea is to create another door for finding solutions through direct negotiation between the parties. ” According to her, an average of 30 days will be sought for proceedings, considering that companies will have ten days to respond to the demand and the demandant will have 20 days to say whether or not to agree with the proposal presented. “If the solution is not obtained on the platform, with the return to PJe, electronic citation will promptly occur. It is an automated flow to make life easier for everyone, ”he said.

Citizen's protagonism

The integration of PJe and platforms will take place, pioneering, in TJDFT and TRF1. TJDFT Vice President Ana Maria Amarante said the initiative will bring greater dynamism to the justice system. She noted that the union of the two platforms will save resources not only for the parties, but also for the government. Judge Daniele Maranhão Costa, deputy coordinator of the TRF1 Special Courts, noted that it is up to the judicial bodies to promote consensual mechanisms for conflict resolution. "With the encouragement of self-composition and transparency, the citizen takes the lead in solving their problem with greater commitment and accountability about the results," he said.

Senacon's holder, Luciano Benetti Timm has classified the agreement between the CNJ and the MJSP as historic and stressed that it will give citizens the possibility to reach faster solutions to problems involving consumer relations. He pointed out that the integration of PJe and will give the citizen one more option to reach conflict resolution. “We want to get more results, with less time and less cost,” he said. Present at the launch, the president of the Brazilian Federation of Banks (Febraban), Murilo Portugal, noted that since the launch of platform, banks have decided to participate actively.
