Possibility of candidatures without party affiliation will be discussed in public hearing


Justice Luís Roberto Barroso of the Brazilian Federal Supreme Court (STF) convened a public hearing on December 9 to discuss the constitutionality of independent candidatures (without party affiliation) in elections. The matter is the subject of Extraordinary Appeal (RE) 1238853, with recognized general repercussion.

According to the rapporteur, the theme goes beyond legal limits and, therefore, it is important to give voice to political institutions and parties, social movements, electoral law associations and politicians, academics and specialists so that the STF gets to know all different points of view about the question. Among the points to be discussed are the practical difficulties related to the implementation of independent candidacies and the impacts of adopting this possibility on the principle of equal chances, the party system and the democratic regime.
