Brazilian Federal Supreme Court declares the quorum of 10% in proportional elections as constitutional.


In the extraordinary session of Wednesday morning (4), the Plenary of the Brazilian Federal Supreme Court (STF) dismissed the Direct Action for te eclaration of Unconstitutionality (ADI) 5920, which questioned the provision of the Electoral Reform (Law 13.165/2015) which stipulated the minimum limit for individual voting of 10% of the electoral quotient to fill vacancies in proportional elections. The decision was unanimous.

The rapporteur, Justice Luiz Fux, said that the aim of the measure is to prevent that the pull of votes in the plea for deputy or councilman elects candidates who do not have the same experience as others, who were voted because of their preparation for political life.
