The Plenary of the Brazilian Federal Supreme Court (STF) decided on Wednesday (11) that the government is not obliged to provide high-cost medications requested in court, when they are not provided for in the Unified Health System (SUS) Exceptional Drug Waiver Program. Exceptional situations will still be defined in the formulation of the general repercussion thesis (Theme 6). The decision, made in the judgment of Extraordinary Appeal (RE) 566471, reaches over 42 thousand cases on the same theme.
All of the justices pointed out conditions in their votes, which will be analyzed in the production of the general repercussion thesis.
