Rule restricting access to public information is suspended


Justice Alexandre de Moraes, of the Brazilian Federal Supreme Court (STF), granted an injunction in Direct Unconstitutionality Action (ADI) 6351 to suspend the effectiveness of article 6-B of Law 13,979/2020, included by Provisional Measure 928/2020, which limited access to information provided by public agencies during the public health emergency decreed because of the new coronavirus pandemic (Covid-19). The injunction will be submitted to a referendum of the STF Plenary.

The provision determines priority attention to requests under the Access to Information Law (Law 12.527/2011) related to measures to confront the pandemic and suspends the deadlines for responding to requests addressed to agencies whose servers are quarantined, teleworking or equivalent and who depend on a public agent or sector involved in combating the disease. It also provides that no appeals will be accepted against a negative response to a request for information.
