The Plenary of the Brazilian Federal Supreme Court (STF) unanimously confirmed the understanding that the measures adopted by the Federal Government in Provisional Measure (MP) 926/2020 to confront the new coronavirus do not remove the concurrent competence or the taking of regulatory and administrative measures by the states, the Federal District and the municipalities. The decision was taken this Wednesday (15), in a session held by videoconference in the referendum of the injunction granted in March by Justice Marco Aurélio in the Direct Action of Unconstitutionality (ADI) 6341.
Health Police
The Democratic Labor Party (PDT), author of the action, argued that the redistribution of powers of health police introduced by MP 926/2020 in Federal Law 13.979/2020 interfered with the regime of cooperation between the federative entities, because it entrusted the Union with the prerogatives of isolation, quarantine, interdiction of locomotion, public services and essential activities and circulation.
