Brazilian Federal Supreme Court deems prejudged the request for setting a temporary minimum income due to Covid-19


On Thursday (30), the Plenary of the Brazilian Federal Supreme Court (STF) judged that the request of the political party "Rede Sustentabilidade" (Sustainability Network) for a declaration of legislative delay by the President of the Republic and the National Congress in the institution of temporary minimum income during the socio-economic crisis caused by the new coronavirus pandemic was prejudged. In an examination of the Direct Action of Unconstitutionality for Omission (ADO) 56, in a session held by videoconference, the majority of Justices acknowledged the prejudice in the request, given the existence of rules on the matter.

The Court recalled that Law 13.982/2020 is already in force, which instituted emergency aid for informal workers, among other measures to confront the crisis generated by the pandemic. The rule created the aid of R$ 600 (which can reach R$ 1,200) for mothers of families), to be paid for three months.
