STF maintains deadline for party affiliation and disengagement in 2020 municipal elections


The Plenary of the Brazilian Federal Supreme Court (STF) voted on Thursday (14) to reject the preliminary injunction in the Direct Action of Unconstitutionality (ADI) 6359, reported by Justice Rosa Weber, in which the Progressive Party (PP) requested a 30-day suspension of the deadline for party affiliation, electoral domicile and disqualification for the 2020 elections, which ended in 4/4. In a session held by videoconference, the majority of Justices understood that even in the face of the Covid-19 pandemic, the validity of rules establishing electoral deadlines must be maintained, under penalty of violating the democratic principle and popular sovereignty.


The PP's request was made in the context of the public calamity situation decreed in light of the pandemic. According to the association, maintaining the deadline would prevent many Brazilians from meeting this eligibility condition.
