Justice Fachin orders suspension of police operations in RJ low-income communities during pandemic


Justice Edson Fachin, of the Brazilian Federal Supreme Court (STF), ordered the suspension of police operations in low-income communities in Rio de Janeiro during the new coronavirus pandemic, except in absolutely exceptional cases, which must be duly justified in writing by the competent authority and communicated to the state public prosecutor's office, the body responsible for external control of police activity. According to the Justice, in these cases, care should be taken not to put the population, the provision of public health services and the performance of humanitarian aid activities at even greater risk.

In his decision, Justice Fachin states that the use of force is only legitimate if it is proven necessary for the protection of a relevant asset, such as the life and property of other people. According to him, if the protocols for the use of force were already precarious, in a pandemic situation, with people spending most of their time in their homes, they become of questionable utility and of great risk.
