Chief Justice of the STF upholds STJ's decision that removed Witzel from the RJ government


Justice Dias Toffoli, Chief Justice of the Brazilian Federal Supreme Court (STF), denied a request for Suspension of Preliminary Injunction (SL 1376) filed by the defense of the governor removed from Rio de Janeiro, Wilson Witzel, against the injunction of the Superior Court of Justice (STJ) that ordered his removal from office for 180 days. Witzel, entrepreneurs and other public agents are targets of Operation Tris in Idem, which investigates irregularities in hiring campaign hospitals, purchasing respirators and medicines to combat Covid-19.

In questioning the decision of STJ's Justice Benedito Gonçalves, who ordered the governor to be removed for 180 days, the defense affirms that the injunction would have been imposed without the indication of concrete, specific and contemporary elements that indicated any risk to the procedural instruction, in addition to claiming that the right to contradictory procedure was suppressed in the case.
