By unanimity, the Plenary of the Brazilian Federal Supreme Court (STF) judged constitutional Resolution 458/2013 of the National Council of the Environment (Conama), which establishes simplified procedures for environmental licensing in land reform settlements. The decision was made in the virtual session closed on September 21, in the judgment of the Direct Action of Unconstitutionality (ADI) 5547.
Socio-environmental function of the property
The plenary followed the vote of the rapporteur, Justice Edson Fachin. In his opinion, the simplification seeks to remove the redundancy of studies and make the licensing process more efficient, thus meeting the socio-environmental function of the property.
