Plenary suspends Tocantins law that institutes state registration of drug users


The Plenary of the Supreme Federal Court (STF) suspended the effectiveness of Tocantins State Law 3,528/2019 that creates the State Register of Drug Users and Dependents, within the State Secretariat of Public Security, from a police report or another official source. The Court followed Justice Edson Fachin (rapporteur) and, by majority of votes, granted an injunction in the Direct Action of Unconstitutionality (ADI) 6561, filed by the Attorney General of the Republic, Augusto Aras.

In the action, Aras claims that the state law usurps the State's private jurisdiction to legislate on criminal matters and criminal procedure and violates the principles of human dignity and the presumption of innocence and the right to intimacy.
