Maintained imprisonment of businessman accused of tax frauds of more than R$ 1 bi


Justice Marco Aurélio, of the Supreme Court of Brazil (STF), maintained the preventive imprisonment of businessman Fagner dos Santos Araújo, accused of leading a criminal organization that may have caused losses of more than R$ 1 billion to the Federal Government and individuals through fraud against the IRS. In rejecting Habeas Corpus (HC) 196408, filed against a decision by a Justice of the Superior Court of Justice (STJ), the Justice did not find any illegal constraint that would justify granting the preliminary injunction.


Owner of Platinum Consultoria Empresarial, Araújo was arrested in October 2019, during the Federal Police's Operation Negative Balance, which investigates a supposed criminal organization formed by accountants, lawyers, a state employee and some intermediaries who would have defrauded tax returns. In March 2020, due to the Covid-19 pandemic, the arrest was converted into a house arrest.
